Common mistakes when assessing capacity No.3
As mentioned in my last post the MCA gives us a very clear tool for assessing mental capacity; the 2-stage test. I am constantly amazed that despite numerous examples in case law, professionals still often use the wrong test, that of the Mini Mental State Exam.
The MMSE (Mini Mental State Exam)
This seems to be a particular favourite of GP’s - although by no means limited to them. I caught a Consultant Psychiatrist using it the other day! It is, in effect a tool for identifying memory loss and visual-spacial awareness. It is not an assessment of capacity. Beware, if your provider is using this, they are not assessing capacity and your assessment is not worth the paper it is printed on
